Motion to set aside default judgement

 Hi,

I've been dealing with a debt collector that is out of state.  They have garnished my bank account just because my bank is in California.  I live in Oklahoma.  Since they started the judgment in CA.  I don't think they can file a foreign judgment.

Anyways, I have a good reason for not going to court.

I'd like to file a motion to dismiss the default judgment, as simple as lack of service, long story.  I would also like to add a document explaining a few items.  This was a default filed by the clerk and has been going on since 2020.

Do you have a form for overturning the default judgment, and an answer document for a few points?

Please let me know.

Thank you!

Hi Deja,

I will probably need to send a different form for this.  Will you send any separate document with the filing?
