I had a default judgement against me I had never been served for, I filed a order to show cause and RJI. I had been made aware of it from a certified usps income execution i recieved. We now have a court date. If this is vacated, now that NYS has new statute of limitation laws of 3 years, would the creditor be allowed to try and sue me again because the initial motion was within the SOL at the time? Or once it's (possibly..hopefully) vacated they have no recourse if it's outside of 10 years?
